The web site
The Canopy Festy information system is a portal type platform, the site is made available to members and readers
in order to search, consult and select, post advertisements, and facilitate relations between members
wishing to attend an Event.
Members can use the features to post, select ads, members form a contract
following a reservation made during the computer transaction.
Canopy Festy only makes the 'Portal' and its functionalities available, and under no circumstances
Canopy Festy does not become a party to the contract between Members.
The Welcome Service mainly concerns visibility at an Event, it cannot be a service or a
offer to occupy the accommodation as nightly “accommodation”.
'Canopy Festy' also applies other main Terms and Policies including those
which have a legal and obligatory character, also those complementary such as
that the Privacy Policy Conditions which relate to the collection of Data

Host and Visiting Members must understand and adhere to the rules set by 'Canopy Festy' during

Selection - Choice of Event:
The selection of the event is made from the main page of the platform, and on the Events page. This page allows you to consult and search for publications.You can also use filters to focus your searches on some criteria such as the type of Event and the location.
Search results are based on their relevance to your criteria and availability.
The order of presentation is based on the date the post was created.
Reservation:
A Reception reservation is a contract to enter and occupy the part of the accommodation having to view the “Event”, to benefit from the “benefits or services”, at the times stipulated in the publication, and the numbers of people selected by the Visitor.The host reserves the right to be present, or to use other representatives at his convenience during the Reception. The Home offers access to an Event, under no circumstances can the Host be responsible for the Event itself, of its content or its duration, where applicable a postponement or cancellation of the said Event.
When the reservation is made and paid, Host and Visitor members benefit from access to private and secure messaging.
Cancellations, Changes to reservations
Some events occur over a short period of time, and only occur once a year. A cancellation is
penalizing both for Hosts, but also for other Visitors.
Resort to a cancellation of a reservation made by a Host or by a Visitor, rules apply to
conditions following. Special conditions apply in
case of force majeure, if an event beyond your control, you could benefit from a refund

Your responsibilities
As a Host and Visitor, you are responsible for your own acts and omissions. The reception must take into account the comfort and safety of people. Host Terms
Recommendations home
Canopy Festy gives you the possibility of using the platform to create an ad to share your Reception linked to an Event, for the benefit of Visitors wishing to benefit from these Events. You have the freedom to set your price, and to associate service services also with the scale of your choice. You control your availability, content and rules for each of your ads. A process of formalizing the contract during the meeting on the day decided to attend the Event may be put in place. The objective is to allow the parties to ensure that the conditions and commitments made are respected, such as the concordance of the Reception, access to the Event and other measures published in the announcement, and the Visitor's respect for the elements published in the announcement, such as the number of people and other elements in place in the reservation. Contract with the Visitor
As a Host, you enter into a contract with the Visitor and you are responsible for providing the Host Service and the Services that you have previously provided on the platform in your publication, this under the conditions and prices set in your ad. If using third parties for the services, as a Host you must ensure that the elements of the reservation will comply with the services offered by this third party. You agree to compensate Canopy Festy for the service fees and applicable taxes for each reservation. Canopy Festy will deduct the amounts due from your payment. The Host undertakes to respect the information posted on its Event page, in particular the information posted in the announcement and those relating to the type of reception and the exposure provided on the Event, on the service services and all other information allowing a respectful welcome to visitors. The Visitor undertakes to respect the rules relating to the provision of the space which allows them to enjoy of the event. Any conditions or terms that you include in your advert, generally speaking, must comply with the Canopy Festy Service Fees and Canopy Festy Additional Legal Terms, to our policies and the information provided in your Listing, and to be disclosed in a visible and understandable, but also in the most respectful way, in the description of your Advertisement.
Ad management
The role of the Host is to create an announcement informing of the availability of a personal space which provides visibility on an Event which takes place mainly outdoors. The characteristic of the reception space must be selected in the form dedicated to this information as well as the dates associated with the Event. The Host also has the possibility of completing this reception with drinks, snacks or more elaborate meal. A Host will need to create an account in order to publish their page containing the information they wish to share. The account creation process includes the declaration of personal data and data relating to the Event(s) and the services made available to Visitors. Personal data will not be placed on the Event sheet, the Visitor will not have access to this data including when it has made the selection and payment. Information elements appear in the forms in order to inform Visitors. This information is necessary for the operation of the site, your account and to guarantee interest optimum ad for visitors. The Host has the possibility to book an Event and become a Visitor. The Host's personal page will contain access to personal data, to Events created, and where applicable information relating to for reservations. The Host has the possibility of modifying his account and his personal information and that linked to the Event. The account closure function is available, including Event deletion. You are responsible for your publication and its content, you can modify your ad for future reservations, those in progress will not support any modification, unless agreed with the visitor. Conditions relating to Visitors
Visitors have the possibility on the platform to consult and select the updated Events. their disposal by the Hosts. The information presented is that as declared by the Host. You must create an account during the payment process. In the event of a reservation being entered, the Host will be informed and will be able to communicate with you via Canopy Festy's 'Host - Visitor' private messaging. The Visitor has the option of creating, modifying or closing his account. He also has the possibility of creating an account as a Host. A personal page is available to access personal data, reservation data and Events if these were created as a Host. Information relating to rights to personal data and site regulations must be checked in the 'legal notices' field when registering and when entering your Home information.
Visitor Responsibilities
When you book a Listing, you agree to pay all charges relating to your booking, including the price of the Reception set in the Advertisement, as well as the prices of the services you have selected. Applicable fees such as Canopy Festy service fees, in-person fees, taxes and any other items identified during checkout (collectively, the “Total Price”). Without feedback from the Host via Canopy Festy messaging, the reservation becomes a contract for the services relating to the publication made by the Host. In addition to these Terms, you will be subject to and responsible for compliance with all conditions relating to the Reservation, including, but not limited to, the conditions cancellation policy and any other regulations, standards, policies or requirements identified in the Announcement or upon payment that applies to the Reservation. It is your responsibility to read and understand these regulations, standards, policies and requirements before booking a Listing. Please be aware that some Hosts work with third parties or as a team member to provide their Host and related services.
Intellectual property
All content of the 'Canopy Festy' Portal, such as, but not limited to: photographs, videos, files digital, information, also via screenshots, data extraction via software and other data extraction applications as well as other tools that have been created for, shared with and/or uploaded to 'Canopy Festy' specifically as part of a collaboration between the “Host” and 'Canopy Festy', may be used by 'Canopy Festy' for communication or commercial purposes. 'Canopy Festy' reserves the right to use the texts and graphic elements added, contained and distributed on the Personal Page, as well as their presentation in the Portal, social networks and third-party sites, without first informing the “Host”. “Hosts” are only permitted to use content, such as graphics or texts, if they have the corresponding usage rights. 'Canopy Festy' cannot be held responsible for rights intellectual property that could arise from the displayed content added by the "Hosts", as well as from their existence. All items provided by 'Canopy Festy' to "Hosts" during the collaboration between the "Host" and 'Canopy Festy', are and remain the property of 'Canopy Festy'. 'Canopy Festy' reserves the right to take back or modify the elements provided without prior notification to the “Hosts”. 'Canopy Festy' does not authorize the use of its industrial and intellectual property rights or any other property or right relating to its website, unless agreed with third parties. The other party must clearly identify the above goods as the property of 'Canopy Festy'. In the event of bankruptcy, recovery or judicial liquidation of the “Host” company or the “Host” if the latter is an individual, he is required to inform 'Canopy Festy', after which 'Canopy Festy' will delete the account of the “Host”. In the event of damage inflicted on 'Canopy Festy' in relation to the content provided by the Service Provider, full responsibility lies with the “Host”. Taxes applicable to Hosts
As a Host, you are responsible for determining, investigating, and fulfilling your obligations under the applicable tax laws to declare, collect, remit or include in your price any VAT or other indirect taxes, tourist taxes, tourism taxes, income taxes or other applicable taxes (“Taxes”). Collection and payment by Canopy Festy
The collection of taxes is delegated to Canopy Festy by decision of the tax authorities of the countries which require it.
This collection is extended to all types of taxes depending on the country.
Canopy Festy is responsible for this collection and/or payment of taxes on behalf of Hosts,
you instruct and authorize Canopy Festy to collect taxes on your behalf
and/or remit these taxes to the competent tax authority.
Some communities require Canopy Festy to disclose tax information about you,
to withhold taxes from your payments. This involves exchanging member information with Canopy Festy
in order to meet these requirements.
Fees
Operating costs
Canopy Festy requires operating costs to support our various services, and provide comfort
necessary and useful for the use of the platform by members.
Canopy Festy generally charges fees to Host and Visitor members for access to
the Canopy Festy platform. These costs can vary in order to best respond and adjust these costs to the functioning of the platform.
Fees are indicated both for Visitors and Hosts during the payment phase and among the pages offered in
the 'My Account' link, such as 'Ordered Events' and 'Reserved Events'.

Use and rules of the Canopy Festy platform

Termination, suspension and other measures

Handling of disputes and claims.
The operating principle of the Canopy Festy platform means that the Homes operate by
the reception of Visitors and the provision of the services offered and reserved. The Host ensures the
operation of this Home.
When a member provides proof of damage caused to the Host and his entourage of people or equipment,
the complaining member may notify Canopy Festy. It is recommended to use personal insurance
or that of the means of payment if applicable, or even any other means of insurance protection, this for a first
resolution and application of possible compensation and their potential coverage by these services.
Canopy Festy cannot be subordinated to a principle of dispute resolution authority as long as it involves
a dispute relating to the provision of services and disagreements between parties.
Member Accounts
To become a member, you must register to create an account to access the main features of the platform. registration is allowed for natural and legal persons, majority is required for persons physical. During this registration you guarantee that you have and declare your rights to be able to register without restrictions of prohibitions under the laws of your country. Payment terms
Payments apply at the time of validation of the reservation by the Visitor. The payment process will be carried out during the Visitor’s meeting with the Host. It is recommended that the parties ensure that the terms of the reservation are respected by each party, Failure to use the barcode may mean a refusal to respect the contract between the parties, to interrupt the payment process, and implicitly to engage the rules relating to cancellation. Confidentiality
Canopy Festy has chosen not to use tokens described as 'cookies' for the operation of the platform and those relating to personal data used to open your member account. The data entered in the forms is only used for the operation of your account as a Host and/or Visitor member, and the functioning of the platform.
